_________________ (Stallion Farm) shall provide transported semen under the following terms, conditions and charges, which will be in addition to those provided in the Booking Contract:

1)      A veterinarian's certificate and current uterine culture (taken only when the Mare is in estrus and submitted to a recognized laboratory) showing the Mare to be in sound breeding condition and free of infection are conditions of the service.

2)      The Mare Owner must have the Mare examined by a licensed veterinarian between 40 and 45 days after the last day bred and Stallion Farm must be notified immediately thereafter in writing of her pregnancy status at that time.

3)      A $350.00 non-refundable semen transport fee must be returned with this contract.  The above-stated semen transport fee covers the first collection charge, one reusable container and the carrier's charge for the first shipment to the Mare. The Mare Owner agrees to provide the container and prepaid, or collects, carrier's charge to transport al shipments made after the first shipment. Mare Owner agrees to pay a $50.00 semen-dispensing fee to Stallion Farm for all shipments made after the first shipment. StallionFarm cannot be responsible for or liable for any delays due to the fault of the carrier.  In the event the carrier will not deliver the semen from its office to the Mare Owner's farm within a reasonable time, it shall be the Mare Owner's responsibility to pick up same.

4)      All fees, charges and container shipping costs due Stallion Farm under this Transported Semen Agreement ( Agreement) must be paid in full before delivery of the semen.

5)      This Agreement guarantees return privileges for the same Mare anytime during the current breeding season, provided the Mare is examined by a licensed veterinarian prior to each request for shipment of semen. Stallion Farm, at its discretion, may limit the number of shipments during a heat period.

6)      Farm assumes responsibility only to deliver live semen in viable condition at the time of delivery to the Mare Owner's farm and U.S. health certificate, provided the Mare Owner complies with all items as stated herein.  The semen must be administered by a licensed veterinarian on the day of delivery or the Mare Owner shall not be considered to have fulfilled his contractual obligations herein, and all guarantees and privileges in this Agreement shall consequently not apply.

 

7)      The Mare Owner shall assume all responsibility for the condition of the Mare.  The Mare Owner shall bear all risk, loss or damage to the Mare, whether by death, disease, injury, infection or otherwise, and by any cause whatsoever, and agrees to hold Stallion Farm and/or its agents and employees harmless for any and all damages associated therewith.

 

8)      The Stallion Farm shall assume responsibility for compliance with all requirements of the breed registry for which it is a member.

 

 

This Agreement, signed by the parties at the places and on the dates set forth below, constitutes the entire transported semen agreement between the parties and may not be amended or modified except by a mutual exchange of written instruments.
